THIS REFUND POLICY APPLIES ONLY IF YOUR ACCESS TO SHAPELY (THE "SERVICE") HAS BEEN PURCHASED DIRECTLY ON THE WEBSITE AVAILABLE VIA WWW.SHAPELY.COACH (THE "WEBSITE").
By using the Service on any computer, mobile phone, tablet, or another device (collectively the "Device"), you as a user of the Service confirm that you have read, understand and agree to be bound by this Refund Policy and any other applicable law.
We may change this Refund Policy at any time without notice, effective upon its posting on the Website. Your continued use of the Service shall be considered your acceptance of the revised Refund Policy. If you do not agree to this Refund Policy, please do not use this Service.
Through the Website, you may purchase access to the paid Content (as defined in the Terms of Use ) of the Service ("Purchase") using any of the following payment methods:
The cost of the Purchase (either one-time payment or subscription payment) is provided within the Service on the relevant checkout screen.
You will be granted access to the Content immediately after your transaction (either one-time payment or subscription payment) is successfully validated by our servers.
Please note that to process the payment we use third-party services (i.e. payment processors). Such services enable the transaction initiated by you and notify us of its completion. We do not store or collect your payment details ourselves. This information is provided directly to our third-party payment processors.
You agree that the Purchase is final, that we will not refund any transaction once it has been made, and that the Purchase cannot be canceled.
Subscription Renewals. All subscriptions renew automatically unless canceled prior to the applicable renewal date. Renewal charges are non-refundable. Cancellation of a subscription does not entitle the user to a refund of any renewal payment already processed. Access to the Service will remain available until the end of the current paid billing period.
One-Time Purchases and Digital Add-Ons. All one-time purchases, including but not limited to digital add-ons, downloadable materials, and PDF books, are final and non-refundable. By completing such purchase, you acknowledge that access to digital content is provided immediately and cannot be revoked once delivered.
For the purposes of this Refund Policy, "Purchase Date" shall mean the date of validation of your initial subscription payment by our servers, and does not include renewal charges.

Notwithstanding the foregoing, you may be eligible to receive a refund of the initial subscription payment in the following cases:
(A) You have experienced technical issues with your Purchase within 7 (seven) calendar days starting from the Purchase Date and have submitted a refund request within the same 7 (seven) calendar days from the Purchase Date, and, as a result, your use of the Purchase is rendered impossible.
To determine your eligibility for a refund, we may require you to provide the following information:
Technical issues may include material crashes, failure to launch, non-clickable buttons, or other defects that render the Purchase unusable, as determined at the Company's sole discretion.
(B) If you did not get visible results after following the Content recommendations and met all of the following conditions:
To be eligible for a refund on the grounds of not getting visible results, the minimum number of completed walking workouts in your plan during 14 (fourteen) consecutive days (two weeks) should be equal to at least 7 completed workouts, namely: at least 35 minutes per each week.
Should you buy a one-week subscription, to be eligible for a refund on the grounds of not getting visible results during the first subscription period, the minimum number of completed walking workouts in your plan during 7 (seven) consecutive days (one week) should be equal to at least 3 completed workouts, namely: at least 35 minutes per week.
We value any feedback and do everything to make our customers happy with our products and services. However, if you are not completely satisfied with our services, you can get a refund according to the terms provided herein.
Generally, if you do not meet the conditions of our Money-back Guarantee set out above, the fees you have paid are non-refundable and/or non-exchangeable, unless otherwise is stated herein or as required by applicable law. In addition, certain refund requests may be considered by our company on a case-by-case basis and granted at our sole discretion.
A refund can usually be claimed only during the subscription period. If the subscription period has expired before you made a request for a refund, we will not be able to provide you with a refund.
Note for residents of certain US states. If you reside in California or Connecticut and cancel the purchase at any time prior to midnight of the third business day after the date of such purchase, we will return the payment you have made.
Note for the EU residents. If you are a consumer based in the EEA or Switzerland, you have an automatic legal right to withdraw from contracts for purchases of Services. However, when you make a purchase of a single item of digital content (such as a video recording or a pdf file) you expressly agree that such content is made available to you immediately and you, therefore, lose your right of withdrawal and will not be eligible for a refund. By signing up for our Service which is not a single item of digital content and is provided on a continuous basis (such as subscriptions to the App) you expressly request and consent to an immediate supply of such Service. Therefore, if you exercise your right of withdrawal we will deduct from your refund an amount that is in proportion to the Service provided before you communicated to us your withdrawal from the contract.
- Exercise of the Right of Withdrawal. Where you have not lost your right of withdrawal, the withdrawal period will expire 14 days after the day you enter into that contract. To exercise your right of withdrawal, you must inform us Soul Stretch Ltd via email support@shapely.coach - of your decision to withdraw from a contract by an unequivocal statement (e.g. a letter sent by post or e-mail). To meet the withdrawal deadline, you need to send your communication to us saying you wish to withdraw from the contract before the withdrawal period has expired.
Where there is a legitimate reason, we reserve the right for each Purchase to refrain from offering certain payment methods and to specify alternative payment methods.
